Ending Judicial Deference
Alabama law does not protect citizens from having the scales tipped against them in challenges with state agencies. And, though the Alabama Supreme Court indicated in 2016 that deference should not be given to state agencies, the law must reflect this constitutional principle. Fortunately, the solution is simple. Alabama courts should interpret statutes and regulations without bias in favor of state agencies. The constitutional separation of powers establishes checks and balances between branches of government. This ensures that the deck is not stacked in favor of one branch by another.
